Hello, This is 13N Recently, the Taiwanese police started cracking down on mods and caused uproar in the biking community a lot of people wrote to me asking me about what California’s regulation on mods Are aftermarket parts illegal? the latest regulation was signed in 2010 by State Governor Arnold Schwarzenegger yes, that Arnold from the Terminator. His signed bill regulates that all motorcycles manufacteured after 2013 will require EPA label on emission parts such as catalyst and mufflers All the bikes will have EPA label from factory Any exhaust system without EPA label will be deemed illegal so you’d think perhaps there’s wiggle room for EPA approved mod? Funny thing is I have not seen any EPA approved aftermarket parts (very rare) simply because EPA noise limit is the same as factory noise limit so if your exhaust is louder than EPA limit you break the law and for those aftermarket exhaust companies none of them would make exhaust quieter than stock ones so with two rules in effect, no aftermaket exhaust can be legal except the exhaust came from factory like some factory performance parts I remember Harley has factory parts like those because they actually ran into issue with EPA and got fined a lot of money so they probably come out with pipe that sounds better, but does not exceed noise limit I’ll post the noise limits up here for you to see …so..obviously I have an aftermarket pipe but how? aftermarket pipes are illegal Aren’t you afraid to get caught? My bike is from year 2008 I am pretty sure I exceeded the noise limit of that year Why am I not afraid of being caught? frankly, 9 out of 10 riders here mod their exhaust too we aren’t afraid of being caught simply because the law isn’t enforced that’s right. Police does not crack down on aftermarket exhaust Unless you rev bomb in residential area or have straight pipe which are way too loud. or when you speed and get pulled over, then you might get questioned by the police otherwise, they wouldn’t deliberately stop you for your exhaust because they have more important task at hand like enforcing drunk driving or speeding law Those require a lot of police effort if they only want to focus on sound limit and use most resources on those what about other areas? who’s going to crack down on drunk driving? well, that’s what the police said as for modification law I think Europe does a better job I recall aftermarket parts in Europe need to get certified to be able to sell to the public and as you know, they come with silencer with silencer, they pass noise limit and become legal mod riders can freely choose legal parts and in this case, if you want to remove silencer to incrase the loudness of your pipe then it’s your own making if you get caught you willingly break the law so accept the ticket if you get caught but that’s different from selling aftermarket parts and installing them if you want better performance, cut down on weight and install the legal parts That’s a CBR and with silencer on the part good job, you don’t break the law you can go on the road everyone’s happy and if you take out the silencer be prepared for a ticket what if you want to go on the race track? take out the silencer have a blast have an awesome time with beautiful sound of your engine speaking of race track one interesting thing to share I’ve begun to mod my Ninja 300 so the timing is a bit awkward I want to start sharing some of my mods but then you guys in Taiwan won’t be able to use those mod anymore that’s pretty disappointing and the awkward part about going on the race track here is that big race track here have noise limit too because of Human Right The residents’ rights Those residents who live near the race track feel the race track is too noisy so they filed complaint telling race track to quiet down because they think race track is noise pollution and must have rules to enforce noise limit the most notable one is the former MotoGP race track Laguna Seca so anyone who goes to Laguna Seca track day are required to use stock exhaust otherwise if you don’t pass the limit you have to get off the track so this is really a “what the fuck” scenario so when California pass the recent rule on noise limit everyone was pissed noise limit on the road, and then there’s noise limit on the track? what the fuck? what do you expect us to do? stop riding? What about bike tuning? how do you improve race bike what about motorcycle performance research? those are near impossible now but what can you do? race track is private. You have to follow the rule. like I mentioned earlier good thing the police don’t enforce the noise law and what about aftermarket exhaust companies? There’s a gray area. Most of their exhaust will be labelled “Off Road Only” or “Race only” for competition use only and “cannot” be used on the road

doing so, they can sell the parts without being restricted by EPA law with “competition only” parts, they can be readily sold and installed but com’on, everybody knows that all those parts are being used for on-road vehicles as I said, when Arnold signs this bill it was going to be even worse kind of like what Taiwanese rider community is facing the initial proposal was to mandate all bikes to follow stock noise limit which means any aftermarket pipe is now illegal all of sudden, 90% of riders with exhaust are breaking the law and need to be fined at the time, there was a motorcycle group (ABATE) who fought hard to resist that proposal it helped, but still couldn’t stop the EPA label rule for 2013+ bikes at least the law didn’t make everyone a criminal all of sudden I am pretty sure a lot of riders want to follow the rule and look for legal parts or even change back to factory parts but if you enforce the law all of sudden on everyone not everyone knows what is legal, and it takes time to find parts. some bike have been modded for a long time too. it’s impossible anyway, that’s my 2 cents hoping to use California’s example as reference to see if there’s any help alright, that’s it folks.
